Governing the use of Ship By Us’s e-commerce logistics and shipping services.

Welcome to Ship By Us. These Terms and Conditions (“Terms”) govern your access to and use of the shipping and logistics services (“Services”) provided by Ship By Us, a company based in Florida, USA (“we,” “us,” or “our”). By using the Services, you agree to be bound by these Terms.

1. User Account and Obligations

To use our Services, you must register for an account and agree to maintain the confidentiality of your login credentials.

A. Accurate Information

You are solely responsible for ensuring all shipping information provided to us (including weights, dimensions, declared values, and customs data) is accurate and complete. Inaccurate information may result in service delays, fines, or additional charges, which will be billed back to your account.

B. Lawful Content

You warrant that all items shipped through Ship By Us comply with the laws and regulations of the origin (USA) and destination countries, and are not prohibited or restricted goods.

2. Pricing, Billing, and Payments

Our pricing is based on dynamic carrier rates, dimensions, and service options selected at the time of booking.

**Rate Quotation:** All quotes provided are based on the information supplied by you. Final charges are determined after the package is processed and confirmed by the carrier.
**Rebilling:** You agree that we may charge your payment method for any additional fees, including but not limited to, dimension adjustments, remote area surcharges, customs duties/taxes (if DDU is not selected), or other carrier-imposed penalties.
**Payment Terms:** Payment for services is required prior to shipment or based on pre-approved credit terms established with us.

3. Shipment, Insurance, and Liability

Our responsibility for your shipment is limited as defined here and by international conventions governing transportation.

A. Limitation of Liability

Our liability for any loss, damage, or delay of a shipment is limited to the greater of the amount provided by the underlying carrier’s standard terms or \$100 USD, unless additional insurance is purchased. We are not liable for consequential or indirect damages.

B. Insurance

You may purchase additional insurance coverage through our platform. All insurance claims must be submitted to Ship By Us within the carrier’s specified timeframe (typically 7-15 days from delivery or scheduled delivery date).

4. Suspension and Termination

We may suspend or terminate your account and access to the Services immediately, without prior notice, if you breach these Terms, particularly in the event of fraud, unlawful shipping activity, or persistent failure to pay outstanding invoices.

5. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the **State of Florida, USA**, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida for the resolution of any disputes.
